EUROPEAN UNION–LEVEL GENERAL TERMS AND CONDITIONS

These General Terms and Conditions (hereinafter: “GTC”) contain the conditions for purchasing goods and using services available on the website www.roastcoffee.hu for Buyers qualifying both as consumers and as businesses. Should you have any questions regarding these GTC, please contact our Customer Service using the contact details provided below.

1. Definitions

1.1. Parties

The Seller and the Buyer jointly.

1.2. Business

A person acting within the scope of their profession, independent occupation, or business activity (i.e. Seller or Business; Buyer where the Buyer does not qualify as a Consumer).

1.3. Consumer

A natural person acting outside the scope of their profession, independent occupation, or business activity (i.e. Consumer or Buyer qualifying as a Consumer, and where applicable Buyer, if the Buyer qualifies as a Consumer under these GTC).

1.4. Consumer Contract

A contract where one of the parties qualifies as a Consumer.

1.5. Product

Any movable item intended for sale and appearing in the offer of the website that may form the subject matter of a contract, including Coffee Products or Durable Consumer Goods (e.g. coffee grinders).

1.6. Service

Any service bookable through the website or otherwise available, such as trainings, educational sessions, or team-building events (hereinafter collectively: “Event”).

1.7. Purchase Price

The amount of consideration specified in Hungarian Forints (HUF) payable by the Buyer for the Product or Service.

1.8. Website

The website www.roastcoffee.hu, which provides the interface for concluding the contract.

1.9. Means of Distance Communication

Any device suitable for making contractual declarations in the absence of the parties for the purpose of concluding a contract. Such means particularly include internet-enabled devices.

1.10. Distance Contract

A consumer contract concluded within the framework of a distance sales system organized for providing goods or services, without the simultaneous physical presence of the parties, using exclusively means of distance communication.


2. Applicable Legislation

These GTC shall be governed by Hungarian law, with particular regard to the following legislation:

  • Act CLV of 1997 on Consumer Protection;

  • Act LXXVI of 1999 on Copyright;

  • Act CVIII of 2001 on Electronic Commerce Services and Certain Issues of Information Society Services;

  • Act CXII of 2011 on Informational Self-Determination and Freedom of Information;

  • Act V of 2013 on the Civil Code;

  • Government Decree 151/2003 (IX.22.) on Mandatory Warranty for Durable Consumer Goods;

  • NGM Decree 19/2014 (IV.29.) on procedural rules for handling warranty and guarantee claims between consumers and businesses;

  • Government Decree 45/2014 (II.26.) on detailed rules governing contracts between consumers and businesses;

  • Regulation (EC) No 593/2008 of the European Parliament and of the Council (“Rome I”);

  • Directive 2011/83/EU on Consumer Rights;

  • Regulation (EU) No 524/2013 on Online Dispute Resolution for Consumer Disputes;

  • Regulation (EU) 2016/679 (GDPR);

  • Regulation (EU) 2018/302 on unjustified geo-blocking;

  • Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods.


3. Formation of the Contract, Scope and Acceptance of the GTC

The submission of an order and its acceptance by the Seller electronically qualifies as a distance contract. The contract is concluded upon receipt of the automatic confirmation of the order.

These General Terms and Conditions form an integral part of the contract concluded between the Parties. The Buyer is obliged to review and accept the contents of these GTC prior to concluding the contract.

These GTC remain available on our website even after the conclusion of the contract.

The territorial scope of these GTC extends to all Member States of the European Union.


4. Language and Form of the Contract

Contracts governed by these GTC are concluded in Hungarian. Contracts concluded under these GTC are not considered written contracts and are not archived by the Seller. However, their content can be clearly determined based on the order and these GTC.


5. Prices

Prices displayed on the Seller’s website are indicated in Hungarian Forints (HUF) and include VAT and any other mandatory charges.

The Seller reserves the right to modify prices; however, such modifications shall not affect contracts already concluded.

If a product price is displayed incorrectly on the website, the provisions of Section 6 (“Procedure in Case of Incorrect Pricing”) shall apply.


6. Procedure in Case of Incorrect Pricing

If an obviously incorrect price appears on the Seller’s website, the Buyer may either:

  • purchase the product at its actual price; or

  • cancel the order without adverse consequences.

An incorrect price particularly includes:

  • a price displayed as HUF 0; or

  • a discounted price where the discount has clearly been miscalculated.


7. Availability

Orders may be placed on our website at any time. Processing of orders begins on the first business day following the order placement.


8. Information on Essential Characteristics of Products and Services

Detailed information regarding the essential characteristics and main features of Products and Services available on our website is provided in the respective product or service descriptions.

Should you have any questions regarding detailed product or service characteristics, please contact our Customer Service using the contact details provided in these GTC.


9. Correction of Data Entry Errors and Responsibility for Accuracy of Data

Prior to finalizing the order, you have the possibility to modify the data entered.

Please pay particular attention when providing your details, as no modifications can be made after finalization of the order. The Seller shall not be liable for performance issues arising from incorrectly provided data.

If you notice incorrect data after finalizing your order, please contact Customer Service immediately by phone or e-mail.

Please note that once the order has been handed over to the courier company, order data can no longer be modified.


10. Use of the Website and Purchase Process

Purchases on our website are not subject to registration, although registration is available.

Users may browse Products and Services by category, search, or filtering options. Product images are illustrative; packaging may vary. Decorative accessories shown in product photos are not part of the product unless expressly indicated otherwise.


10.1. Adding Products or Services to the Cart

To purchase a Product or order a Service, select the desired quantity and click the “Add to Cart” button.

You may review the contents of your cart at any time via the “Cart” button in the upper-right corner of the page.

After placing all selected Products and Services into the Cart, you may continue the purchase process by clicking the “Checkout” button.


10.2. Entering Order Details

After clicking “Checkout”, the contents of the cart and the total purchase price will be displayed.

In the “Shipping Information” section, you may select the preferred delivery method.

The following information is mandatory:

  • e-mail address;

  • full name;

  • billing address;

  • phone number.

The system automatically copies billing information into the shipping section. If delivery is requested to a different address, please provide the separate shipping address.

Additional requests or comments may be entered in the “Comments” field.


10.3. Submitting the Order

After entering the required information, click the “Submit Order” button if you wish to continue.

You will then see an overview of your order details. Please carefully review:

  • cart contents;

  • entered data;

  • additional information;

  • payable amount.


10.4. Finalization of the Order

If all information is correct, you may finalize the order by clicking the “Place Order” button.

Information displayed on the website does not constitute a binding offer by the Seller.

By clicking “Place Order”, the Buyer expressly acknowledges that:

  • the order constitutes a binding offer;

  • acceptance by the Seller creates a payment obligation.

The Buyer’s offer remains binding for 1 hour. If the Seller does not confirm the order within this period, the Buyer is released from the offer obligation.


11. Payment Options

The Buyer may pay:

  • online by bank card; or

  • cash on delivery (COD).

In the case of COD, payment to the courier may generally be made either by card or cash.


11.1. Online Bank Card Payment

This payment method provides a convenient and secure solution.

By clicking the “Payment” button, the website redirects the Buyer to the official SimplePay platform where payment may be securely completed using bank card details.


11.2. Cash on Delivery (Hungary Only)

COD is only available for deliveries within Hungary.

If the Buyer wishes to pay upon receipt of the Product, the “Cash on Delivery” payment option should be selected.

Payment may be made to the courier in cash or, where available, by bank card.


12. Electronic Invoice

By accepting these GTC, the Buyer expressly consents to the Seller issuing electronic invoices in accordance with Hungarian law.


13. Order Processing and Conclusion of the Contract

Upon receipt of the order, the Seller sends an automatic confirmation e-mail containing the order details.

This automatic confirmation does not constitute acceptance of the Buyer’s offer; it merely confirms receipt of the order.

Acceptance of the offer occurs through a separate e-mail entitled:

  • “Order Handed Over to Courier Service”; or

  • “Service Confirmation”.

The contract is concluded upon receipt of this separate e-mail.


14. Performance Deadline

The general performance deadline is no later than 15 days from confirmation of the order, or, in the case of Services, on the scheduled service date.

If the Seller is in delay, the Buyer is entitled to set an additional deadline. If the Seller still fails to perform, the Buyer may withdraw from the contract.


15. Reservation of Rights and Retention of Title

If the Buyer previously failed to receive an ordered Product or the shipment was returned marked “Unclaimed,” the Seller may require advance payment before fulfilling a new order.

The Seller may withhold delivery until payment has been successfully confirmed.

If the full purchase price is not received due to currency conversion differences, banking charges, or similar reasons, the Seller may request the Buyer to pay the outstanding balance.


16. Consumer Information

Under these GTC, a Buyer qualifies as a Consumer only if they are a natural person acting outside the scope of their profession or business activity.

Consumers are entitled to the right of withdrawal without justification.

For contracts concerning the sale of goods, the withdrawal period is 14 calendar days from the day on which:

  • the Consumer; or

  • a third party designated by the Consumer (other than the carrier)

takes possession of the Product.

In the case of multiple Products delivered separately, the withdrawal period begins on receipt of the final Product.

The Consumer may also exercise the right of withdrawal between conclusion of the contract and receipt of the Product.

The right of withdrawal may be exercised through a clear declaration.

If the declaration is sent within the deadline, the withdrawal is deemed timely exercised.

The Seller shall confirm receipt of the withdrawal electronically.


Exceptions to the Right of Withdrawal

The right of withdrawal cannot be exercised in cases listed under Article 16 of Directive 2011/83/EU and Section 29(1) of Government Decree 45/2014 (II.26.), including in particular:

  • goods or services whose price depends on financial market fluctuations;

  • custom-made or personalized products;

  • perishable goods;

  • sealed goods not suitable for return for health or hygiene reasons once opened;

  • goods inseparably mixed with other items after delivery.


Withdrawal Rules for Services and Events

For Event-type Services (e.g. training sessions or team-building events), the Buyer may cancel or reschedule at least 5 working days before the Event start date.

If rescheduling is unsuccessful, the purchase price shall be refunded.

Within 5 working days before the Event, rescheduling or refund is only available in cases of illness or hospitalization, subject to proof requested by the Seller.


17. Seller’s Obligations in Case of Consumer Withdrawal

If the Consumer validly withdraws from the contract, the Seller shall reimburse all payments received, including delivery costs, without undue delay and no later than 14 days after becoming aware of the withdrawal.


18. Buyer’s Obligations in Case of Withdrawal or Termination

18.1. Return of Products

The Consumer must return the Product without undue delay and no later than 14 days from communicating the withdrawal.

The deadline is deemed met if the Product is sent before expiration of the period.

The direct cost of returning the Product shall be borne by the Buyer.


18.2. Liability for Depreciation

The Consumer is liable only for depreciation resulting from use exceeding what is necessary to establish the nature and characteristics of the Product.

If a sealed coffee product is opened, the Seller will refund the purchase price only in the case of a justified quality complaint and only if at least 80% of the product is returned.

Taste profile complaints are excluded, as flavor perception is subjective and highly dependent on brewing method.


19. Warranty Rules Relating to Products

19.1. Statutory Warranty (Implied Warranty)

In the event of defective performance, Consumers may enforce statutory warranty claims under Directive (EU) 2019/771 and corresponding Hungarian legislation.

The Buyer may request:

  • repair;

  • replacement;

  • proportional price reduction; or

  • withdrawal from the contract.

Defects recognized within one year from delivery are presumed to have existed at the time of delivery unless incompatible with the nature of the goods or defect.


19.1.1. Deadline for Enforcing Warranty Claims

The Buyer must notify the Seller of the defect without delay and no later than 2 months after discovery.

Warranty claims cannot be enforced beyond:

  • 2 years from conclusion of the contract; or

  • the expiry period indicated on the Product,

whichever occurs first.


19.1.2. Conditions for Enforcing Warranty Claims

Within 6 months from performance, the Buyer only needs to prove that the Product originated from the Seller.

After 6 months, the Buyer must prove that the defect already existed at the time of delivery.


20. Product Liability

Consumers may choose between statutory warranty claims and product liability claims, but both cannot be enforced simultaneously for the same defect.

The Seller, acting as manufacturer, may be required to repair or replace defective Products.

A Product is defective if it did not comply with quality requirements applicable at the time of placing it on the market.


21. Mandatory Guarantee

Pursuant to Government Decree 151/2003 (IX.22.), the Seller provides mandatory guarantees for certain durable consumer goods such as coffee grinders.

Guarantee periods:

  • 2 years for products priced between HUF 10,000 and HUF 250,000;

  • 3 years for products priced above HUF 250,000.

Coffee products do not qualify as durable consumer goods.


22. Complaint Handling

Complaints regarding Products or the Seller’s activities may be submitted via:

The Seller shall attempt to resolve complaints immediately where possible.

Written complaints will be answered substantively within 30 days.


23. Protection of Intellectual Property

The Seller’s website constitutes a copyrighted work under Hungarian copyright law.

Unauthorized use of graphical, software, or programming solutions displayed on the website is prohibited.

The “Roastar” and “Röast” brand names are registered EU trademarks of Roastar Zrt. Any unauthorized use, imitation, or reproduction is unlawful.


24. Partial Invalidity

If any provision of these GTC is incomplete, inaccurate, or invalid, the remaining provisions shall remain in force.

The invalid provision shall be replaced by the applicable mandatory legal provisions of Hungarian law or the relevant mandatory consumer protection laws applicable to the Consumer.


25. Governing Law and Jurisdiction

These GTC and contracts concluded between the Seller and Buyer shall be governed by Hungarian law.

Where mandatory consumer protection rules of another EU Member State apply and cannot legally be excluded, these GTC shall be interpreted accordingly.

The Parties shall first attempt to settle disputes amicably through Customer Service.

Any unresolved disputes shall fall under the jurisdiction of the Hungarian courts.
